No. It is illegal to keep most native wild species in the US.
If you can get the bird back into the nest, that is the best thing to do. Do not worry about your scent being on the bird. It is absolutely incorrect that the mother would reject it because she smells you on the baby. A bird's sense of smell is not that acute.
If you can not get it back in the nest, contact a licensed wildlife rehabilitator. You should be able to find one here: http://www.tc.umn.edu/~devo0028/contact.htm These people have the training and the resources to properly feed and care for a sick, injured or orphaned wild animal.
In addition to it being illegal to keep the bird, it is also not a good idea. If you do not have the proper training, you can do more harm than good. I like the way this website explains it: "First of all, there are federal and state laws that prohibit keeping wild birds. And there are so many important but subtle elements to raising a wild bird that the job is only legally entrusted to licensed rehabilitators. Many well-meaning people raise baby birds or rescue birds from cats or after accidents, and sometimes they don't realize that the bird in their care is suffering from a serious dietary deficiency. Some of the problems aren't apparent to untrained people, but can cause death, or make the bird less likely to evade predators or to survive harsh natural weather conditions."

DO NOT KEEP IT! The best thing to do is get ahold of a resucue bird center. There are laws that are against keeping birds. The sad thing is you can not raise it like it's mom. It has a human scent on it now and will be regected by all birds alike. If this helps. In Somerset,Kentucky. There is a Raptor Club that will take baby birds of any kind and raise them to the hope of realease. They are trained in this feild. In the meantime. Feed the bird mashed up worms from a bait shop ort from your yard. BUT please do not keep it forever. You can email me at melameter@gmail.com for more imformation.

I do not think you can legally take care of it. I would suggest you call the nearest wildlife shelter to come take care of it. If they cannot get there for a while you might want to go to the pet store and pick up some meal worms or waxworms and smoosh them up, mix with water and feed baby bird with a dropper very carefully. but please only do this as a last resort. the baby can choke to death if you feed him too fast but if he doesnt eat every couple hours he will die.

No, you cannot.
Look in the phone book for a bird center or animal hospital in your area. They will take care of the bird.

It's still better if the professionals take care of it like the vets and those with expertise and knowledge in caring for birds. They'd know what to do, and you can ensure that it is in safe hands.

I would take it to a vet because if it fell out of tree it might be hurt. Also, the vet can probably tell you how to take care of it and give you some tips or books to read about it. Good Luck!

It it hungry and cold. Put it back into the nest. Mom can take care of it much better than you can. Make sure it is securely in the nest. Do not worry about your scent making Mom reject it. Please get it into the nest asap.
