My best friend just turned 18 and has been in a relationship with a guy who is 32 .... they seem to be very much in love, however this guy has a past...( you know, two strikes and on parole).... god forbid her family finds this out, HOWEVER if they do, what can be done? Is there a statue of limitations on this? And if they were to get married would this change anything seeing as to how she is now 18?..... Please Help? Thanks :)

If the sex occurred prior to her 18th birthday, in the State of California it is illegal as follows (statute of limitations at the bottom):

Cal. Pen. Code §261.5. (a) Unlawful sexual intercourse is an act of sexualintercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age.
(b) Any person who engages in an act of unlawful sexual
intercourse with a minor who is not more than three years older or three years younger than the perpetrator, is guilty of a misdemeanor.

(c) Any person who engages in an act of unlawful sexual
intercourse with a minor who is more than three years younger than the perpetrator is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one
year, or by imprisonment in the state prison.

Statute of Limitations

In the case of misdemeanor statutory rape, the statute of limitations is 1 year from the occurrence. Whenever statutory rape may be charged as a felony, meaning whenever the age difference between the parties is more than 3 years, the statute of limitations is 3 years.

Marriage will NOT change the matter.

If she's really your friend you would do your best to get her out of this relationship. The guy has some sick issues... No 18 year old girl is ready to be on the same emotional level as a 32 year old.

He sure got his fantasies answered though didn't he... I believe he may have some pedophile secrets...

To answer your question I hope her parents do find out and charge him and I do believe whether or not they are married or not will not have any bearing on the case.

Yes it is statuatory rape, if he was having sex with her all along. With his past criminal record, I hope your friend comes to her senses and not marry this guy, she could be in for a life of misery. I feel the young lady might be being manipulated by this guy, and being bearly of age, she needs to talk to someone before she says I Do. Marrying the guy does not change the fact that he had sex with a minor, this may be what he is afraid of and thinks that he will be free and clear by getting married. She or someone really needs to talk to her parents about this, whole thing just does not smell right.

His "felony" relationship with your friend already violates his parole, and would send him back to prison for the remainder of his "original" sentence "without" consideration of the "NEW" Felony charges for the sexual assault of your friend (his 3rd strike and 25 to life)...Your choice but your friend's safety should come first, and her family should be made aware of her relationship and his past..!! 18 is the age of consent in California, but the relationship started when she was still a minor (17)...marriage "NOW" won't change anything..!!

There could very well be a case if they tell too soon but in most states the age of consent is down to 16, i think 14 for some states. So it may not be a problem.

18 is an adult in most states. I just hope your friend is not a victim of some one who just likes younger ladies.
