i dont want the kid get put into care, the kid is 9 and wants to live me my family, the mother will say yes

Check with your social services office in your city. It sounds like you are a very nice person to take on the care of 9 year old. They will know the law regarding the father abroad. You will need to be careful that the child won't automatically be sent abroad if the mother is not able to care for the kid. Check to be sure this can't happen. If so, I would think the Mother would likely never see the child again. If the Father is paying child support, I don't know the answer to that one. I don't know if you take complete financial responsibility. Is this for a short time or forever? You didn't say.

If the mother wants the child with you then yes, the child can stay, but it won't be legal fostering through the state, just an agreement between you and the mother. You'll need copies of the child's medical insurance and written permission from the mother for you make decisions concerning the child's medical care and school enrollment if the child is with you that long. All you need is the consent of one parent, but to be safe make certain the father doesn't object or you could face legal battles with him if he wants to be an a**.

If the mother gives you guardianship of the child you can take it but you will not be able to receive money to care for the child through the state. If you want to be a foster parent to the child, the mother will need to give custody to the Department of Human Services and you can apply to be the childs caregiver, in our state its called kinship care.

Yes, in most states you can foster the child, but if I were you I would definitely go through the State to make sure the family doesn't try to pull a stunt down the road and accuse you of anything (like kidnapping, etc.).

Unless you have legally become a foster carer then the only option is like the others have suggested is to get a legal document that will prove that you become the childs legal guardian.

Better get this checked out with social services so there isn't any heart break later. What if the mother changes her mind in a few months or years time?

if you want this to be legal so no one can take the child from you later, you need to talk to social services and go to the courthouse....

I think it would be OK. But i would have her give you temporary custody. For medical purposes.
