I bought a second hand motorbike from a dealer around 8 week ago and it came with a 3 month gurantee.

It has started having problems. I took it back to the dealer last week and they said the coolant top wasnt on right and they have ordered a camchain adjuster. On my ride home i noticed the inner right air intake hadn't been put on correctly was catching on the forks when I turned right. I took it back to the shop and they fixed it.

After my ride to work the following morning I noticed coolant had leaked and had made a hand size patch on the car park . Also the camchain seems to be a lot worse.

The dealer is wanting another chance to try and solve the problems but seems reluctant to give me my money back. I think I would be a lot happier with a refund as the problems and service have put me off a lot. Also I think the dealer wouldnt be as "helpful" if anything went wrong in the next few weeks when the guarantee runs out.

Where do I stand legally if I ask for my money back?

3 month warranty to fix the bike not to refund money. Your only way out is trade it back for a better bike at the same place. And stick them with that maintence pig. Always buy new equiptment like bikes that way your the only one that has driven it so you know the maintence history. Really important if you use it as primary transportation.

Does the guarantee say 3 month money back? I bet it doesn't. It looks like the only thing the guarantee is that for 3 months you will be bringing it back for more repairs. You can try your luck in small claims court, you might even win because of all your time trouble and expenses, I would start the law suit before the alleged warranty expires. Ask the guy who sold it to you his name and address so you will know where to send his court summons, it might just change his attitude! You will need to know that to file a suit! Good luck.
