My girlfriend/Fiance' is a UK citizen. She wants to live here with me in America. We plan to get married but we want to do it in our own time without a time limit, as she is still in the divorce process from her UK husband. Is there a way for her to stay permanently or will I need to fly her back to UK every 2.5 months to keep her always under the time limit? Are there any options for 2 people in such situation?

The only way she can stay more than 90 days in the U.S. is for her to obtain a tourist visa. With a tourist visa she would be able to stay up to 6 months.

You need to understand that she cannot live in the U.S. She is applying for the Visa Waiver Program, that do not require a visa, but if CBP officers at the airport suspect that she is living with you, her entry into the U.S. can be denied and she will be send back to UK, and the only way she can reenter the U.S. will be with a visa; she will not qualify for the Visa Waiver Program anymore.

Fiance Visa are issued with limited times for marriage in the US. If you do not marry in that time, the visa becomes invalid.
So in your case i don`t think you can keep her with you all the time, unless you decide to marry her. Yes i also agree with the lady comments below mine that getting her a job would be a good idea too, but those kind of jobs with visa waiver are hard to find.
She needs to go back and re enter again i would say

You need to check with the immigration laws of America and see if there is a way around it.

If she was able to get a proper job in America and get a workers permit through them then she should be able to stay longer then the 90 days.

Or you can just both come and live in Australia...we love both the British and Americans..lol

You can get some information from the Immigration and Naturalization Service (INS.) They will be glad to give you that information. I believe it may be just to apply for a change in her visa. Stay happy.
