You would have to talk to a lawyer about that. Do you have regular visitation? It probably depends on the reason that he has custody and you do not. He is legally entitled to do this unfortunately, so if you want them with you, you will have to go to court to fight for them. I'm sure it will be an easy case to win if (and no offence intended) you are a fit mother and financially capable of caring for them. They should be with family, not in a foster home.

The fact that your husband had FULL CUSTODY of them in the first place, says alot.
Putting them up for adoption or foster care was probably the only option your exhusband could see as the best alternative.
Can you afford them??
Are you capable of taking care of them.
Children need more than just your presence.

Even though you don't have custody, you still have legal rights. You are their next of kin. You need to go to the clerk of courts and file a petition to gain custody. Personally, I don't know how this could have even happened!! Good luck

Your first move is to see an attorney. If you can't afford one, then call your state Bar Association, and see what they recommend. Not knowing where you are, I can only give you that general advice.

I really don't know, but can't you talk to the judge or some type of case worker over the case and see what is expected of you to get them back?...stability.
