How do you go about writting a motion to dismiss traffic citation for west virginia. I got a ticket and want to write a letter but have no idea what to put in the letter. I was wondering if there was some sort of format you are supposed to follow or certain info you should have in the letter.

I'm in the military and stationed in SC. I called and the lady told me to write a letter to get a court date when i was on leave.

You have to go to court.

Most speeding tickets can be dismissed based on your attitude and just appearing at court with a good attitude. A lot of times they will make a bargaining arrangement with you. Such as, you pay court costs, no ticket will be recorded, or If you got a ticket for a 70 in a 55, they will knock it down to a 62 or so in a 55.

Just depends on the people seeing over your particular arrangement.

Does West Virginia give the option of taking a Traffic Safety course? In California, at least, you can take a Traffic Safety course and have the ticket dismissed, provided it has been 18 or more months since you last took the course.

In most states and localities, you have to appear in court to challenge a speeding ticket. You are entitled to a hearing on the citation, but you most likely will have to appear in person. Writing about it would require giving some kind of evidence to show that the citation is not deserved.

If you write a letter, you're screwed. Go to court. That's really the only way you've got a chance to get out of it if you're not a lawyer.

I can't think of a single thing you can put in your Motion to Dismiss because the facts are as such: you were clocked speeding - you were doing 75mph in a 70mph zone. The law is the law and you broke it. There is nothing you can do to get around that.

go to court tell the judge that you were going 75 in a 70 he or she will laugh at you and make you pay the fine 5 over is speeding. pay the ticket or go to traffic school.

write to the county clerk but I will say you still will have to go to court
