He can't. He's not the beneficiary and that is who the insurance company pays.

For Muslim insurance policyholder in Malaysia, according to Section 167 (2) of Malaysia Insurance Act 1996, beneficiary(s) of a Muslim policyholder receives the policy money as executor(s). The beneficiary(s) must distribute the policy money in accordance with Syariah Law (Islamic Law).

For non-Muslim insurance policyholder in Malaysia, according to Section 166 of Malaysia Insurance Act 1996, a competent beneficiary must attain the age of 18 and above with sound mind and no infirmity of mind or body.
If the beneficiary is a minor (incompetent beneficiary), the parent of the minor will become the beneficiary.

Because Life insurance policies are disburst by contract only the named beneficiaries have any legal rigth to the money. This is why it is so important for people to meet with their agents at least once a year to make sure all information is up to date on the policy, especially the beneficiaries.

The answer is an easy one, but not one you will like. You can't get a piece of it. The proceeds of a life insurance policy pass directly to NAMED beneficiary and are free from the claims of IRS and creditors. You can always fight things in court but you'd have one heck of a battle, it would cost a fortune, and the odds are the benefit will have been long paid out before there was a decision. If you did win(very unlikely) you'd have to collect from the beneficiary

You can't. Life insurance policies are NOT generally contestable.

Whoever is named as beneficiary, gets the money.

He might not even have been the policy OWNER, which means, he doesn't even get to CHOOSE the beneficiary.

But maybe you can file for social security survivor benefits on behalf of your minor children.

I don't think he can, sorry. As long as the beneficiary named is alive, they get it. Unless of course, they prove that they murdered the policy holder. You might try talking to the other woman about him getting some put into an account or something. Good luck.

I would not count on that. Put yourself in HER shoes. Would YOU give away part of the life insurance benefit left to YOU ?

There is only ONE way

look at the nomination form & see whether it is yr son's father's signature.

May need a lawyer to assist u as the insurance company practice strict P&C policy.

If u feel that the signature differs then u have a slight chance

mbr and goodman gave the right answers. Once you proved maternity, you should had a lawyer ask the court to force him to buy life insurance OR you could have purchased life insurance on him.

The best you can do now is file for Social Security Benefits.

Then go see an insurance agent about life and disability insurance for yourself.
