I think that the way one should look at this is that we are America. We are the beacon on the hill. We are the country that others should want to be like. All of the freedoms, all of the oppurtunity and prosperity.
We do not torture, imprison without trial, deny lawyers to the accused.
I understand being upset by a person that does not follow the rules. But that is what makes a civilised place to live all the better because no matter what we follow the rules. When we get down on there level and show that we are no better than they are we loose face in the world and people no longer think that we are what they want to be like and this is a problem.
I am not getting down of other countries here but america once was an example for the world and now we are not. We have a lot of work to fix all that has been thrown away by the current leadership of this country. And to be sure none of the people running for office have the ability to do this. So it maybe another generation before we can heal these wounds.
No I would not be happy if it was my family member to have been killed. But, I would hope that there is a voice of reason saying that we should try them and jail them and not torture them the way they did my family member.

There is no proof that all of these people are terrorists. Our military performs sweeps that sometimes net every male in a city block. It is certainly possible to be in the wrong place at the wrong time under these circumstances.
What if China invaded the U.S. and incarcerated and tortured anyone they thought might be a threat to them.
Are the Iraqis picked up during sweeps terrorists by definition, or are they simply people fighting an invasion? Perhaps there are some of both...but we torture them all?

I guess the main question is who decides they are terrorists? I believe there are one or two cases of seemingly innocent people getting caught up in this process, so it's obviously not a foolproof thing.
That said, I'm pretty much with you as far as pitying the poor terrorists.

Who is to say that these people are actually terrorists? Most of them have been withheld without having any actual charges filed against them. When you start making exceptions to who the law does and does not apply to, where does it end? The law and all the rules and regulations that go with it should be upheld for EVERYBODY.

The issue is there is no judicial process to determine if they ARE terrorists.
Who decides that? The military?
That's not how our system works.
