work have not paid me for bank holiday monday because i was off sick on tuesday morning, is this legal?

It is legal as long as it is a written rule with that company. The reason they do this is because some people take advantage of the paid holiday and fake being sick the day after or before the paid holiday. Unfortunately, you probably do not have much justification for a law suit.

Yes, it's perfectly legal. Check your employee handbook under holidays. You probably will see the following: "In order to be paid for the holiday, you need to be present the day before and the day after the holiday unless previously approved to be off."

Holidays are not legally required to be paid at all. Most companies do offer holiday pay, but can put this type of restriction on it. Some employers will pay the holiday if you are out the day before or after, if you have a valid, provable excuse (ie: sick with a doctor's note)

In my contract, although we get paid for bank holidays even though the office is closed, if we have either the Friday before or the Tuesday after off work (sickness or unauthorised absence, not pre-booked holiday), then we won't get paid for the bank holiday. I would check your contract if you have one.

I don't think so. The fact you were off Tuesday has nothing to do with you working on the monday. Legally you should be paid for when you worked, regardless of whether you were sick the following day.

No - you are entitled to be paid. Make a claim for the money owed to you (In writing - keep copy) and give your employer several days to respond to you. If, at the end of that period you have not received an appropriate response then you can issue proceedings in an Employment Tribunal under the Wages Act.

Maybe they can do according to the rules they have laided down but to be fully sure check out further this issue with the relevant person over these matters thank you

If your company only pays you SSP rather than full pay for being off sick, then they can pay you SSP for bank holidays if you were "sick" on those days too.

It is legal in Canada but you should check with the Labour Board or whatever you have that is comparable to it. You can dispute it with them.
