Ive lived in 3 story apartment's 2nd floor for 7 years and recently we got some new neighbors downstairs. They bang at my floor (their ceiling) for everything! if we walk around on our tippy toes they bang with their broomstick at the spot were were standing and if we sit down they bang where the chair is. We even whisper and try NOT to sneeze because we get bangs on the walls and a very loud "SHUT UP" from downstairs. To my surprise theres a loud surround sound system going off at 1 AM thats either them or right next to them but its loud to the point where can feel more than bass yu can tell which movie it is. but yet NO complaints to that!. theyve even gotten the manager to come and tell us to quiet down. What can we do? the carpet is really worn out its basically fuzzy concrete on an old 70's building. maybe new carpet and padding? Super fuzzy carpet? dynamat on the floor!? and can i get evicted for this?

well you did not have any problems before, Did you?
if not then it is not you but them who are the problem
but looks like they are complaining first to the manager so be careful and talk to the manager about. try to get proof for what you say about them may be record the banging on the ceiling and the shouting so they can be evicted instead.
but remember you did not call for this they call you for duty and your duty is to make things straight for you not for them. you sound like a nice guy and these people sounds like trouble makers and aggressive people so be careful with this kind of people.

Both are. You share a building with people - so a little consideration should be expected. What you could consider is putting some extra padding under you when working out. Cork floor plates for example dampen a lot of sound. If you can do two layers of that, hardly any noise should be heard at all. Another solution could be to ask a friend to do the workouts, while you visit your downstairs neighbor, to hear how loud things sound. Then, try again with the extra padding - and ask your neighbor if that noise level is acceptable. You are sharing the same building, so try to get along. In the end, everyone will be happy.

Here's what I would do. I would get the manager to come to my apartment (without letting the downstairs neighbor know) and stay for awhile. I would do normal activities and see if the downstairs neighbor complains or bangs on the ceiling. Then I would ask the manager if what I was doing was creating excessive amounts of noise. I would ask the manager to go down and talk to these people and tell them what just happened. Maybe that would solve the problem. I think it would be helpful to have an unbiased third party witness everything because until then it's just your word against the neighbor with the manager stuck in the middle.

Before you get all worked up like those people suggesting to get even so far, ask them to let you inside their unit while your roommate walks around and does things as usual upstairs (your unit) and hear for yourself if indeed there is unbearable noise. It could turn out to be true since the house is old. About the stereo system going off at 1AM, find out whose it is first and talk to the owner. You've been there for seven years. The manager should know you well enough by now to vouch for your "quiet" life style.

I used to live on the second floor of an apartment and would get the same thing from my downstairs neighbor. One day I had finally had enough, and I marched down there and asked her brother to come upstairs with me. I told him to walk around (normally--not stomping), turn on the TV at a moderate level, scoot the chair out quietly and sit down, etc.) and asked her to stay down there and listen. He did all this very quietly, then we went back downstairs. When we got down there, she apologized profusely and never banged on the ceiling/yelled at us again.

Try talking to them, if that doesn't work I would just live my life in a normal way as before and not worry about them, try as much as possible to put them out of your head. When they whinge, remind them that in seven years you had no complaints. Just remember, if they are leasing and hitting the ceiling with a broom etc, they are probably leaving marks on it. Maybe you should talk to your landlord as well. If they are been difficult neighbours, they will no doubt also be difficult tenants and the landlord is probably itching to get rid of them as well on any flimsy excuse.

All things being equal, there is NO way you can be evicted over this.
However, if THEY are actually being ridiculous about it, a case for eviction could be built against THEM. It wouuld really have to be pretty extreme, though.

I'm basing my opinion on your word alone, and nothing else.

You need to talk to the apartment manager about this. Tape the noise that you hear so you can play it back for him/her. Also at the beginning of the tape record yourself saying what time it is.

Go talk to your downstairs "neighbors" and explain your side of the stituation. They should be living on the top floor!

Thats what you get for living below someone.
Let them call the cops or the HOA and you can tell
them your not that loud anyways. Or complain about them!
See how they like it and they will stop.
