I also have a baby with an illegal, though he is also married to another woman and has 2 children with her. They were married in 2002 or 2001 and after they had their first child they went to mexico to go through the proper channels. They refused any paperwork on his marriage(i.e a marriage certificate and the childs birth certificate) and he was told it could take up to 7 years(this was in 2003). Not quite sure what way to tell you to go, though people could be a little less racist. Yes, name calling because of who you fall in love with because he is colored is RACIST! If I had been asked if I would date or have sex with anyone of another race 2 years ago or more I would have told you, heck no! Was fine for everyone else just not for me..... Love happens people!

First, you have to get married.
Second, he has to go back to Mexico.
Third, you have to file a petition to sponsor him with the (CIS) Citizenship and Immigration Service. You'll file an I-130 and all the supporting documents.
He will be called to the US embassy in Mexico City or the US Consulate you designate on the petition. He will have to complete a lot of paperwork and take a complete physical exam. Then he'll be interviewed.
Because he was an illegal alien, in the United States, there's a chance he'll be given a penalty, up to 3 years, during which he'll have to wait in Mexico before the visa is issued.
Now, that's the legal way to do it. There's no other way.

carefull about being honest!! I got 10 year bar for staying in the US for 2 years while waiting for a visa after I was told by the INS to wait for the visa results!! 3 years wouldn't be that bad but 10 seems ridiculous for going to school there!

All I can say is good luck with that. I see that some people have told you to marry him, but that is no guarantee. INS has figured out that people get married for citizenship, and they are really cracking down. They have broken up a lot of legitimate families who couldn't prove that their marriage was real and not for papers, when that really was the case. This is true even when there was a child involved. My best advice would have been, don't have a hcild with an illegal because your family will likely get broken up, but it's too late for that now.

Your baby can, but your boyfriend should be saying Adios.
He can go thru proper procedures to get legal immigrant status. Yes, that involves contacting the authorities, and yes, that means he might get his butt shipped back to Mexico.
However, if he really wants to be with you and baby, he will go thru proper channels.
Illegals are just that: Illegal. Even if he has a job, he's still illegal. On the other hand, if he talks to INS and offers a deal to turn in his employer, he might get a better deal.

I'm absolutely disgusted by the terrible answers some of these people have given you. To become involved with an undocumented Mexican does NOT make you any less of an American!
There is ALWAYS hope, remember that. Go to your public library, do research on immigration and such, consult INS. He will most likely have to go through form after form in order to have a chance to stay. Good luck to you and your baby.

the baby gives him the right to apply for a working visa. That will give him time to decide if he wants to become an citizen. The government doesn't want to support your baby so they will allow him to stay to support you both.

Well I'd say you were pretty foolish in the first place for having a child with an individual you knew was an illegal. How can you even consider calling yourself an American? Well, I guess you probably don't even think of it that way, do you? You and your partner must be living it up on the monthly check. I'm sure you don't believe that what he did (coming here illegally) was that 'big' of a deal, but in reality it is. EDUCATE yourself. You really couldn't care less about this country or its future because you're too caught up in your own pathetic web. You're a traitor to this country - and in all honesty, you were USED. He should have thought about following the law FIRST instead of creeping over and impregnating an American citizen to gain citizenship. Because the 14th Amendment is being totally warped to benefit illegals at this time, I don't think you'll have to worry.

He should turn himself in, and go back to MEXICO if that is the outcome.. Then if he is serious about living here, he should go through the PROPER CHANNELS to return here.. If you want to stay together as a family, then JOIN HIM IN MEXICO, while you wait for the proper process to complete.. America is filled with Babies, and that is no excuse for a father to have any special rights to live here, unless he is on a visa, or is a citizen.. LOTS OF KIDS GROW UP HERE WITH ABSENTEE FATHERS.. SINCE DIVORCE AND SINGLE PARENTS HAVE BECOME THE RAGE OVER THE PAST 20 YEARS.. SO GROW UP.. and LIVE WITH THE CONSEQUENCES OF YOUR ACTIONS and encourage him to do the right thing here.

Is it still called an anchor baby if the father is an illegal but the mother is a citizen?
So having said all of that is the anchor baby cause to stay or do you need to marry him?
