My SFC said I am going to counsel you on misconduct...does that mean UCMJ action?

No. An enlisted member cannot impose UCMJ...that can only be done by a commissioned officer in a commander position. He can RECOMMEND UCMJ, but only the Commander can actually impose that on you.

You will (probably) receive a DA 4856, which is a "Developmental Counseling Statement" documenting what you did wrong and hopefully making a plan on how to correct your actions. This will stay in your file until you PCS to your next unit, when it will be destroyed. You will be asked to sign it, which you should (some people get stupid and refuse to sign it, but all that means is that you are an idiot...). If you don't agree with what it says, select the "Not Concur" box when you sign it.

If you continue to be a screw up, these counseling statements will be used as documentation to support what the commander ultimately decides to do with you, either UCMJ, bar to reenlistement, etc...

It sounds like you have a good NCO. Consider yourself lucky. So many folks in the Army screw up over and over and are never counseled.

It is a process to annotate in writing that you misbehaved under the UCMJ or orders of of your superiors. i.e. You show up late to your PT formation so, although not Court Martial material really, you will be counseled in writing to formally show your misconduct. They do this in the civilian world too. If you are counseled continually for your behavior than the employer (in your case the military) can build a case to punish you or get rid of you.

All you're getting is a counseling statement, it's a piece of paper describing your misconduct. You'll probably get some crappy detail as a consequence. That is unless it was something severe, like a DUI...

Perhaps. At a minimum it means you did something wrong and you are getting written up but that is the only action being taken at this time. The write up will go in your record and if you do anything else wrong or repeat your actions the write up will be used as evidence of repeat or patterned bad behavior.

it means he's going to talk to you & educate you about your bad behavior. Misconduct means your BEHAVIOR, or should i say Bad Behavior that you have been doing. He will type up a statement saying that & it will go into your file. That looks bad on you. I would advise you to change your ways, this is not Elementary School. You are an adult & should act like one.

Usually it means a counseling statement which is removed after six months from your 201 file if you keep your nose clean. I assume you already know what you did wrong, if you don't, then you have more problems than you think.
