I am a lawyer. I would not sue for damages. Instead, I would sue to get an injunction to prevent this.
However, I think you are jumping the gun. Before filing suit, you and your attorney should speak with the school again to let the school know you are serious. A stern letter from your attorney should hopefully do the job. I do not think the teacher should be fired. The teacher should just be admonished to keep his/her religious practices out of the classroom.
Your question is very inflammed and ranting, and you do not say much about the teacher's praying. Is she simply saying grace silently or quietly to herself before eating lunch, or is she leading the class in prayer? The former is permissible, the latter is not. The teacher is not required to leave her religion at the door. She may wear an emblem of her faith and so on. Make sure what you are doing is about your son and not about your political agenda.

Thats a tough spot. Assuming this teacher is doing more then simply praying to herself quietly without inciting others ("God says you should/n't do *this*" ,"let's thank god!" ,"let's pray!" etc.), I would suggest that you hire a lawyer and have them send a letter to the school informing them that further action will be taken if necessary. That way you give them a real warning shot and they don't need to lose any money if necessary, as many schools are in dire need of cash these days. If they don't respond in a reasonable amount of time (make sure the letter has something about how you look forward to hearing their response, etc.) let the dogs loose. A letter head with a lawyer on it always gets attention quickly, and this way all the school gets a chance to keep their much needed money and the teacher gets fired.

Hey, Gazoo, speak for yourself! I am a licensed attorney in several states, and I must warn you. It is not illegal to pray in school so long as it does interfere with the proper functions of the school. In other words, this teacher is not allowed to pray when he should be teaching, but between classes he can do whatever he wants. Be careful, or this teacher may have a defense and could counter-sue you with a reasonable cause. Move to get him fired, but sue the school and the teacher at your own peril. You will likely lose against the teacher, and if you win against the school, they will most likely appeal as for up the chain as they can go. That will cost you a lot of time and money, and even if they do pay, it is the students of the school who will suffer the most. The county will likely not be able to afford some of the necessities should it have to pay you. Do you really want to do that to the children and other teachers?

For real. Well what should you do, well pray. You want to come against a teacher for praying. If he did not pray directly with your son he is not in error. Some christians are not silence when it comes down to praying to God. Now if your son just heard the word God spoken by the teacher, that is not offences to sue anybody.
People wants to abolish God in the schools, why not Santa Claus. They represent him in Department Stores and he is not real but imitation while God is real. Why hurt someone for doing something good.

The law does not prohibit private prayer. But the teacher is obviously motivated, and needs work for a Christian school.
I would not protest if they taught religion to my children. The Bible teaches the importance of values, and in the judgment, you will have to answer for the soul of your child that you squandered for the world. When that child is lost, it will blame you, it's parent for saying: "you told me it wasn't true.
So, study. I would suggest reading the New Testament, and a secret Bible code at http://abiblecode.tripod.com It proves Jesus is the Messiah.

The teacher has rights too, lady. Everyone - students, teachers, staff - is allowed to pray in school, even in public school. I assume that your beef is with the fact that he is praying aloud to a captive audience (or perhaps encouraging or requiring students to join in?).
The fact is, God DOES have a place at school. Any history class which does not address the significant contributions (positive and negative) that religions have made to civilizations throughout history and to the United States itself is a no-good teacher. It is nearly impossible to learn about baroque music (Bach, Handel, and the like) or Renaissance art without considering religious themes. And religion is still as relevant and germane a topic for studying current events as ever.
I sense that you are not one of those ignorant parents who wants her child to stick his head in the sand and pretend that religions (or worse, religions other than the ONE TRUE RELIGION that she and her family practices) don't exist. Just bear in mind that, without study of God and of the things that people have done in the name of God, your child cannot receive a well-rounded education and be prepared to take his place in our democratic society.

jesus freak................sorry but thats not an insult. praying is not illegal. freedom of religion ring a bell? i feel sorry for your kid being exposed to such an extremist parent. i feel so sorry for all of the people that you are bugging, and they probably think you are overreacting anyway. what do you have against christians except that they are doing something that you are probably informed of by some biased person. if i could, i would yell at you for about an hour for being so uptight and the next time you want to rant about christians, go yell in a pillow, not on the internet.

i agree. however i dont think it is wrong to pray in school at all. however he should do it by himself. not out loud. if that is the case as much as i am a christian i do say it is law. i think it is cool he is doing what he thinks is right. now if he prays to himself and silently then i dont think that is wrong at all. however i think it is a 2 way street too. as christians why should we have to listen and be forced to listen to things that we dont believe. i.e evolution and the big bang theory.
if you say skip the class my pastor went thru this with his daughter. they were told she would be expelled if they took her out of science during this time period. that was i think 2 weeks or something. so she was forced to take it. then she took it and yes she contradicted the teacher every which way that was with truth. like how old the earth was. in school they make it sound like it is fact that it is 4.5 billion years old. she would point out that is not fact at all. because it is not. then they wanted to expell her because she was doing this. however our pastor fought that and won because first they forced her to have to take part in it and second she is a student and students are authorized to do that. just like a student can pray and talk about God just parents and teachers are not allowed to.

I have a kid in school and he gets christian views from a secular public school...
the thing is if the principal is christian the teachers who are as well can get away with ...uh...whatever and have a speedbump warning system and slap on hand built into place. have your kid get it on tape, audio for proof
anything else would be like trying to prove Jesus or a ghost
I have to ask kid all the time what he learned and counter the overt religion indoctrination with facts and logical questions to get my kid to prove/disprove god, so far he just points to the sky at a star/planet and thinks that's 'god' where god is..
I said the people in S. Hemisphere can't see it, why would a god to this, is he only the US/Eurpope/Canada/Russia god?

be rational and review thier curriculum which after being passed is legit at local levels, maybe illegal at Federal Levels

I agree - Christians should obey the law as long as it's not a command telling us to break one of God's commands. It is not illegal for a public school teacher or student to bow her head and silently pray to Godl, as long as she doesn't force the students to say the prayer.
There are lots of things taught about Roman gods, pagans, and fiction in public schools, however. The Harry Potter books are very popular right now and they are based on real Satanic worship.
