i recently was a victim of racial profiling ,slander and discrimination by a employeeof a store in silercity nc and the insurance company of the store is asking me to let them talk to my witness without me listening.The insurance company offered me a couple of hundread dpollars to go away i told them he was crazy.Can i sue this store or do i sue the employee for this racist statement she made in front of witnesses (all blackmen steal).And do i let him talk to my witness without me

There's no above-board reason they should be talking to your witness without your attorney being present. Why don't they take an official deposition if they're so interested?

You are in a legal matter without a lawyer for your side, or a paralegal, or someone who knows the law.

A person who makes legal decisions without such support is taking an awful risk. Caveat Emptor.

Go to lawyer office. You need legal advice. First ask what is the $ rate ... e.g. $ 250.00 for one hour of their time. If the $ is more than you can pay, then find the Legal Aid office.

It is illegal for people who are not lawyers or paralegals to give legal advice, like on Yahoo Answers, just like it is illegal for people who are not medical people to give medical answers. A lot of people are breaking those laws.

The legal advice you want from the lawyer office or Legal Aid is:
* What are your rights with respect to the store's insurance company ... such as finding out if they really are an insurance company as opposed to some crook.
* Is it legal fro the insurance company to do a deposition of a witness without the witness having someone present to protect the witness?
* With just your word, and that of one witness, what are the odds of winning any suit against the store?
* Should the law suit specifically name the racist employee, the employer, the shopping district that the store is contained within, anyone else?
* What are the costs of such a suit, out of your pocket, if you do not win ... like $ 10,000.00 perhaps?
* What can you reasonably expect to get if you win the suit, what is it you want to get?

For example, you could say that you are not in it for the money, you want the company to expend some percentage of their marketing money in advertising that they are truely sorry for hiring racist(s) and advertise what they are doing to make sure this will never happen again in the future.

For example, you could want the shopping district or mall where the store is located to take measures to ensure an environment that has some level of civility towards the diversity of possible customers.

For example, you could insist that the racist employee go to some kind of mental health place to learn how to be a good human being.

I believe that law suits for money sometimes make people more hostile, do not solve the core problem, plus if you truely agree with me, and can convince others of this viewpoint, then it may be easier to win the law suit, or get some plea bargain arrangement where you can be satisfied both that your mental health injuries have been repaired and the bad guys much less likely to continue this behavior towards others.

You should sue the store. The employee's nothing but a dumb cracker who doesn't have enough to pay you what you are owed for the racist remark. You need to get an attorney who handles civil rights cases working on your case, and quickly.

Don't give up the name of your witness until your lawyer says it's time to do so.

You should have taken the couple of hundred when they
offered it. It was just to get you to hush up and go away
because you were a minor nuisance.

If you get an attorney and try to be a real nuisance,they
will call out the corporate guns and crush you like a bug.

Getting our feelings hurt is not something we can sue over
and expect to win.

I don't understand why they would be asking your permission to talk to your witness - they don't need it! If they know who your witness is, they have every right to talk to them without you even knowing about it - and your lawyers are not allowed to tell your witness not to talk to the other side.
If, however, they don't know who your witness is, you don't have to tell them until you call the person at trial.
My advice would be to take the money! If you lose at trial, you will be up for a large amount of costs, and if you win, you may not be awarded enough to even pay your lawyers.
