hi i would like to get some advice if possible. im 15. i live in oregon. ok so heres my story. well i had got some boltcutters and i took them to school. me and a friend left during class and went to the locker room and cut a lock. their wasen't anything in the locker so we left. meaning we did not steal anything. later i guess they saw us on camera or something and so they did a backpack search i had my boltcutters in it and some other pernal items that they said i "stole" whitch isn't true. how would i prove their actually my items with out a receipt? ok so anyways the cop was trying to blame me for other thefts in the locker room that consisted of breaking into locks from past weeks when i do have a valid recipt saying i had bought them 2 days ago. so after he took my statement. whitch was last week, ihaven't heard from him since. well i saw him today and i asked him what's going on? and he said that he will be seeing me real soon and he also said that i better give up my stolen items and told him i don't have stolen items (whitch is true) he told me not to give him that bullshit. what do i do? what could i be charged with? a fine? i know i'll be on probation. but for how long? is he going to get a search warrant since i keep telling him i don't have any stolen items? thank you very much for you'r time and effort and i hope to hear from you really soon. thank you.

Yes, bolt cutters are considered tools-of-trade for burglars. Right place/wrong time for you? Maybe. But as long as they dont find any REPORTED stolen items on you, you will be okay. But if you were found with these items, then you will have to face the consequences. And if this is your first offense, fortunatley, you are just a minor and the crime is not that serious. Neither is juvenile probation (nothing compared to adult probation). You will just have to stay out of trouble. Get caught doing something else illegal, and you can go do juvie prison...otherwise known as gladiator school.
Also. dont let that officer bully you. If it has already been a week and nothing has been done, you are probably in the clear. But next time dont talk to him without your parents- NO MATTER WHAT!
Keep mum about this to your friends too - you would be surprised to who will turn over on you just for the fun of it.
But on the real - keep cool! If the cop is telling you to turn over these items, he is fishing. Dont change your story and dont tell anymore stories - even ones you already have told.
Keep us posted. I have a feeling you are in the clear...but dont take this as us condoning that kind of behavior. Learn from this.

Well you got yourself in some kind of pickle here. The law says that the police only need probable cause to arrest you. I think that having you on camera with the bolt cutters would qualify as a probable casue that you in fact had something to do with the lock being cut. Also the fact they found the bolt cutters in your posession. I think that you knew what you were doing when you brought the bolt cutters to school and you had criminal intent to steal someones personal items from their locker. Now as far as the other items that were stolen days prior to that. Even if you didnt do it, I am sure the word got around the school that stuff was stolen from some lockers. Why would you decide that it is a good idea to bring some bolt cutters to school and steal stuff. I think that right now you are the prime suspect in all of the thefts and the damage to property that occured. I think you should come clean with the police and tell them everything you know

If you can prove the items in your backpack are truly yours, the only thing I can think of that you can be charged with is possession of burglary tools (bolt cutter) and vandalism of property (cut lock). Both are misdemeanors and if you don't have a history you will probably get probation. It will give you a record and you need to watch your step from now on as every time a theft happens at your school, or any other you attend, they will be looking very hard at you.

You admit your took bolt cutters to school and used them the break into a locker. Now you expect us to believe someone else has been stealing from the locker room by cutting locks of of lockers. You also state you believe there are cameras in the locker room. If I were on the jury, the prosecution would not have a difficult job. I recommend keeping that in mind if anyone offers a plea bargain.

First of all, if you haven't told your parents about this, do it right away. They are going to find out anyway. It sounds to me like the school cop is not sure what to do, and is trying to intimidate you into saying something that he can use against you. My guess is that he'll do this for a couple weeks, and then he'll get angry that you are "getting away with it", and will try to nail you really hard. That's why you need your parents help. Remember that you did something wrong/illegal. At the very least they can charge you with breaking and entering, trespassing, and destruction of school property. I say come clean with what you did, so you can make amends and move on. Be careful that you don't get snagged for something worse that you didn't do. Having said that...take a good look at yourself and where you are in life. Why would you do what you did anyway?

Hello. I used to work at a law office that represented both adult and juveniles in criminal cases.

First of all, do NOT answer any more questions the police ask you. You are only legally required to give them your full legal name, address, and ID if they ask for it. Do not answer anything else. Tell them that you will not speak to them without a lawyer. They will try to say things such as "If you just talk to us we'll make sure you are not charged." This is not true! They are allowed to legally lie to you to get a confession out of you.

Secondly, you are going to need an attorney if you get charged. Most attorneys will not take cases until you are charged.

Do not ask the cops about the case. It may remind them of the case if they've already forgotten about it.

Keep silent, don't talk about this case to your friends (they can be used as witnesses), and don't answer any questions! If in doubt, contact a local attorney or your local public defenders office for advice.

As for the items they think are stolen it will help you if you can find someone who can truthfully testify the items you had were not stolen. (example: your mom can say she bought it for you or that she's absolutely certain it is yours)

well you're probably going to be in some trouble, but don't worry about it. I did dumb things when I was 15 too, now I just laugh about em. Some of em included going to court and doing community service. It just seems like a big deal at the time. But so long as no one gets hurt, it ain't that big a deal in the long run.
