Am especially interested to know if there is a Latin legal term for "mistaken identity".

Can't find a legal term, and Latin didn't really have a word for 'identity' as we use it.
Agnitio errata is about as close as I can come - that's 'erroneous recognition'
For extras, Agnitio contrecta would be 'stolen identity.'

Since 'identity' has no correspondent in Latin I would suggest to turn around and translate as "PERSONAE ERROR (or ERRATUM)" (in English 'error of person').
A different option could be "PERSONA ERRATA" (Mistaken person)

Frustra Identity is the latin translation. However, I do not think there is a "legal" latin terminology for this as there is for mens rea (guilty mind).
