How much do you really know about the law & your rights when approached by Law Enforcement Officers that just get off on the prestige /Power Of The Badge? How many of you fear Law Enforce-ment Officials? Why? Don't just assume you know enough about any situation that law enforcement might throw your way, whatever the case may be. Guilty before proven innocent has become the law of the land, especially here in Kern County ,Northern CA. What are your opinions of why some Cops abuse the authority of their power. Do you think they intended to manipulate the power, even before they decided to become a Cop? Keep in mind that their line of duty is to protect , NOT to harrass. Are they being taught these procedures in the Police Academy or were they just born a DI-CH to begin with? Perhaps abuse was in their past, or we could chalk it up to the big bully in school that always took their milk money. Never fear them for they too, put their pants on in the morning just like me & you.

I think that you are judging all law enforcement officers based on a couple of bad apples. I personally feel that law enforcement officers have always been fair and respectful to me. But I don't know your situation. Maybe location changes things, I don't know. I can say this, in every profession, there are some nice people and some mean people. Its not about the profession, its about the person.

Kern County is located in CENTRAL California, NOT Northern California. Are you referring to Bakersfield Cops or the Sheriffs Dept of Kern? There's a BIG difference in the way that these 2 Departments handle things. What's your question? What happened, did they hit you in the head off camera? Bakersfield used to have a sign that read "SUN~ FUN~STAY~PLAY". Perhaps you came on vacation & left on probation? That's an inside joke when they bust someone from out of town who thinks they know it all! P.S. Kern County is extremely large & has been undergoing a population surge & housing boom. It has Gang problems & drug problems with a jail that needs to be rebuilt & is extremely overcrowded with inmates. The Los Angeles trouble makers drive over the hill to Kern County or take the Greyhound bus & cause a lot of trouble for the already stressed out, underfunded & understaffed law enforcement agencies that are trying their best to answer calls as they come into the dispatchers. Add the fact that the Officers' must work in extreme heat (over 100 degrees) & you should have some insight as to why some Officers could be a bit on the nasty side when you start up with them! They're only human & so are you. Just try being real when you have Officer contact & you may find that you don't have as many problems!

You know, I believe that david s is right. But, the fifth constitutional right does'nt have only have to do right to keep your silence, it also has to do with search and seizure. Filing a complaint with the police commissions will go on their personal record and keep them from being promoted for a while. It's amazing how law enforcement officials take an oath to withhold the constitution above county and state regs and laws, and above their own opinion. But, they don't know half the constitution!!! And if the cop were to be able to testify against this guy in court, and he did lie, that's still perjury. Don't sweat it, guys. So what, I mistaked it for "private property be seized for public use." It would be a violation of your freedom of speech if a cop tried to put you in jail for something you didn't say, and it's still perjury if he wrote a false report. And the only reason why his statement got so many thumbs-down is only because he's experienced how to properly address the situation. I'm sure it's upsetting to an LEO if it was made public about the commissions thing. But I live where a lot of cops take it waay out of proportion...Theres a cop here that smokes ice and leaves women out naked in the middle of country...Also, an ACO shot an escapee in the head and killed him when he knew darn good and well he could have disabled him from the waist-down. My father and three uncles served on the CHP for many years, and my grandfather was a judge back in the day. It's sad that there are cops that are unusually rough, pull hair, beat ppl on the head, rape, use drugs...etc, but I am and we are not the judge...We all answer to God when we die. Yet, Fawntel is right, too...Amidst all the power hungry cops or smart-butted one I've experienced, there are lots of level headed, kind, explanatory police men and women out there...About 45% of the whole entire force, probably, is like that. But, there are poop-heads everywhere you go.

I love that singer and the song even though it always brings tears to my eyes. I think it's up to all of us to help protect children by looking out for them and report suspected cases of abuse, not pretend it's not there or wait for someone else to do it. It's not necessarily the law enforcement officers, it's the whole system. It can work, but when it doesn't, that's heartbreaking! We need to help and make kids feel safe. Some, even the older ones, are afraid to come forth and seek help. Some, especially the younger ones, don't even know there is help for them.

heres the way i see it. forget protect and serve, for the most part. cops are given quotas, which they usually deny, but its a fact. the more cops, the more the quotas. in comes the profiling, the concentration on getting the quotas, and the real menaces to society get away with more than they should. they are trained to intimidate. some of this i can understand. if i were a cop, id want criminals afraid of me too, but not the elderly and kids, and thats the way it is. hurting people, stealing,causing damage of any kind, i can see being forceful to a degree. the jails are full of people who are caught driving with no license. violating probation, which they shouldnt be on in the first place, ect. it is not so much the cops as it is the greed of our judicial system. it is supposed to uphold the constitution, yet it violates it dailey. they are kinda like the oil people, any way they can think of to make a buck, they will do, no matter how unjust. this would be our congressional representatives, which is a joke in its self, and our beloved circut court judges who seem to have no conscience at all. there is where the real problem is. of course cops abuse their power, so do others in different fields. the professional politicians and judges are so far removed from the general public that they have no clue as to the plight of the people they represent and judge. they are just as criminal as the guy embezzling from the company, or someone convicted of fraud.

Police have broad powers to investigate people based on reasonable suspicion.
Your question is nice and vague and does not pertain to any certain thing. It is a nice rant about how you are being harassed though.

Read some case law and stop watching NYPD Blue and you might actually realize That what you are calling harassment is just standard garden variety police work.

Oh my god. That's what I'm saying. Your first Constitutional Right? Are you talking about your 5th Amendment Right not to incriminate yourself? Perjury is when you lie on the stand under oath. I really doubt your story. The Police can still talk to you buddy.

Uh, Actually 4th Amendment deals with Search and Seizure. Look it up.

you aint seen nothing yet.. wait till the United Nations takes over....... all in the name of Homeland Security. There will be no more cops. The men in black will see to it that you have no rights for sure then. Its called State Police, and will be coming to a town-city near you soon.

I think were you live has a lot to do with it. I recently moved to a some what bad area and I find myself arguing with a police officer because, she thought that she I did not know my rights. She felt stupid after arguing with me. Because, I know my rights well enough to let her know how to provide harassment. However, most police I think believe that most citizen don't know there rights. However, if you live in a area where there a lot of crime and drugs. The police are going to more than likely treat all individuals the same and misuse their authority.

i don't think that any of us know enough about what rights are. i do tend to agree with you that there is a presumption of guilt. they can write you a ticket for anything they like and you are inconvenienced at having to go through the time of appearing in court to straighten it out. i imagine that dealing with the public is hard work and they burn out / have a lot of attitudes and some of them abuse the bit of power that they have. it is never wise to argue with them ... please get an attorney and argue in a courtroom where you have a "chance" at justice. get an attorney if you need one and learn to avoid any intereaction with police that you can so you do not have problems.

One time a cop pulled me over and said that I was calling him a cussword, when I was really telling my friend that was walking that he was a king. The cop said "Oh, Yeah???" You wanna go to Jail for runnin' your mouth??" And I said, "You're threatening my first constitutional right under perjury. May I have your badge number???" Immediately, he backed off. When you feel like you are being harassed by a power hungry police officer, Just ask for their badge numbers or remember their name that you saw on their badge. Then, File a complaint with the POLICE COMMISSIONS and you'll be asked to be present at the next commission meeting to present your complaint. I hope this helps.
