My friend is 14 and shes dating a guy whos 16 my friend birthday is aug 28 1992 and her boyfriends birthday is august 25 1990 is that satatory rape or is it okay for them to be together?

They may have trouble those three days of August next year, when he will be over 18 and she will be under the age of consent. Other than that, they probably don't have to worry about their activities being tagged as "statutory rape".
("Irresponsible", "foolish", "risky", "bone-headed", and some other admittedly-judgmental adjectives come to mind, but not "statutory rape"....)

They can date but not have sex. It will be statutory rape if anyone older (and sometimes the same age) sleeps with a minor. The legal age is 16 in some states and 18 in others. I don't know Minnesota specifically.

The age of consent in Minnesota is 16 and the two people must be at least three years different in age in order for it to be statutory rape. (This assumes that both parties are over 13.)
Therefore it looks like they are ok (this is not legal advice.)

That is statutory rape. He could go to jail. Your friend (whom I assume is you) is way too young to be having sex. Is she taking precautions to prevent herself from becoming pregnant? From preventing herself from getting AIDS and herpes for which there is no known cure? And of course the run of the mill STDs that can cause pain and infertility but are curable?

For them to just be dating fine-sex, might as well just give her a baby and put him behind bars. Make sure she knows he could get put away. And ur a good friend being concerned.
