I thought that under a month to month lease in NC you are required by law to have a 30 days to vacate a property if there is an eviction?

Hi Stacey
Your best bet to get an answer is to contact the attorney generals office. Telephone: 919-716-6400

It's free to ask them questions. However, if there was an eviction, most judges will state how long a person has to move out, it can range any where from 24 hours to 10 days, I have rarely heard of one month, but it is the courts decision.

Feel free to call the above number, they can clarify the laws to you.
Hope this helps you and best of luck.
Stacey

You are supposed to call the cops and file a report for noise after 10 p.m. Wait until the end of the month in case they leave. Your manager and landlord are not concerned with your mental problems. Apartment living has its drawbacks.

42-14. Notice to quit in certain tenancies.

*A tenancy from year to year may be terminated by a notice to quit given one month or more before the end of the current year of the tenancy; a tenancy from month to month by a like notice of seven days; a tenancy from week to week, of two days.

It would appear that a MTM tenancy can be terminated with one week's notice, according to NC Statute.
