The trial is set for November but it is a 5 hour drive away and I was told it would take two days! They would pay for my travel and stay-whoopdeedoo! I wish the two would settle out of court and I told the attorney that at the deposition-I said that better do it I'm not doing this again! Won't my deposition stand for me being that far away?

yes you do. If you do not, he can have the court issue a summons to appear. If you don't appear a comtempt of court charge could be leveled against you.

It depends on many variables. I know that sometimes depositions are acceptable if you live out of town, have an illness or a family member who you care for or if your work wont allow the time off for one reason or the other. Your safest bet is to ask the attorney and hope thats all but I do know that if there are further questions (from the other attorney or judge/magistrate) you may still be required to appear. No, unless they serve you with a subpoena which they probably don't want to do because it might tick you off and turn you into a hostile witness. But, if you have been deposed and if your testimony is important to one side or another, you will be subpoenaed.

No, you are not forced to apppear. If you are served with a summons to appear then you must appear.

If you tell him you will not appear he may subpoena you.

you only have to go if you get a summons

Only if you are Subpoena'd. If not, then no you do not have to go.
