Just explain your situation, if you can't reach them on the phone then just send them a letter. It's not a big deal as long as it hasn't been years.

Hope you gave your tax guy a check, and he better hope he didn't cash it.

The IRS will sometimes waive any penalties and interest if a sufficient explanation is provided, so I would suggest sitting down with your tax preparer and firmly requesting that he or she write a letter on your behalf advising the IRS that the failure to file was not your fault.

I know someone who had the very same thing happen to him, and the IRS waived the penalties and interest after his consultant wrote a letter of explanation.

Go ahead and file your return late with the amount you owed according to your return in any case, whether the consultant prepares the letter or not. The IRS will calculate any penalties and interest you owe if the explanation is not accepted.

First, talk to your tax preparer. If he didnt file it, then it will still fall back on you. Then call the IRS to explain what happened and maybe you can file an extension, even though its late.

Otherwise you will have to pay a penalty. Depending on what you owe, it might not be too much.

Contact the IRS. You may have a lawsuit against the consultatnt, but you are ultimately responsible with the IRS.

They are not as bad a people make out. If you contact them, they are willing to work it out. I have had a number of weird things, like lost tax payments in the mail etc. They handled it very well.

File a late return, and ask for a waiver of the fine. Report the tax consultant, and get a new one.

Get your paperwork back from them and get it filed as soon as possible. Interest and penalties are accumulating if you owe anything.
