You may want to call legal aid or the CA bar association to find some free or low cost attorneys. it would be best to have an attorney draw up a temporary guardianship, you would not need to go to court. That way in case your daughter needs medical care or anything while you are taking care of yourself it will be easy for your sister.

I took custody of my younger sister when she was in high school. All I had to do was contact the district she would be attending, pick up the required forms (essentially a form giving me guardianship signed by my parents and notorized) and go ahead with things as usual. I never retained legal custody via the courts and never had a problem.

I don't knwo the exact name of the form, but if you call your local school system board of education and ask for the Attendance or Enrollment office, they can definitely help you out. You may need to go in with your daughter and sister to meet with the superintendent to get a special waiver.

You have to go Thur the courts, go to the magistrate4s office and get a temporary guardianship paper drawn up. Both parties have to sign. Good luck and many blessings.

EDITED TO ADD:
Just so you understand why I answered the way I did, I AM an attorney and as such, I must advise you that if there is an adjudicated father (either by court order or through an acknowledgement of paternity) then every answer you have been given is going to backfire on you.
Unless BOTH parents agree to a guardianship petition, it is void on its face and the father can take the child from such guardian.

you can just write a form giving her temporary guardianship while you are ill...detail that she is your power of attorney for matters of school, illness and whatever then go to a notary to sign it...most are free at your bank...the court house things like that. get clean so your little girl and you can go on.

yea you can go to a notory and have costidol right that just gives your sister the right to take her to the Dr. and to enrool her in school if she is in school. its not custady or anything i would not recomend giving her any kind of custady that way when you get back on your feet all you have to do is go get her no court or anything
