what would you call it when an employee takes excessive breaks (say 45 mins to 1 hour,,,,out of an 8 hour day)
need proper wording for disciplinary action

everyone knows via employee handbook that they are to provide 8 hours of work for their workday if this means they want to stretch their day out to 10 hours (taking 2 hours for this or that for instance) that's ok but they have to provide 8 hours work for 8 hours pay

Have you talked to the employee about this? That would be the first step - a verbal warning. Then if it continues, a written warning. "Excessive breaks" would pretty much cover it.

Well first, I think it would need to be addressed in an employee handbook. Until the employee KNOWS it is wrong, you can't discipline them for it.

Revise your handbook, THEN if the employee continues to take excessive breaks, you have the handbook to fall back on, and can easily write them up for violating the rules of the company.

You'll have to speak to the employee and let him understand that his contract requires him to put in 8 hrs a day. Seek his cooperation at the end of the conversation.

After the session, if he still persist, you should issue a disciplinary letter. If he still persist, issue another stronger worded letter. Depending on your country's law, you may terminate him after the third and final letter.

All employees get breaks for working 8 hour days.

The only way to track paid or unpaid breaks is to have your employees punch out for their breaks.

If they see that it is not in their paycheck maybe the breaks won't be so long.
