(I know I just asked this, but i screw up writing the additional details, so i'm re-asking w/ said details...)

O.k. so about 2 weeks ago, my moms boyfriend, threatened that he was going to attack me, because my mother left him (and now went back...) I know most of the time he's all talk, but he does have a past record of assault and various other things. Now that she's back with this guy, a few family members told me I should get a restraining order (they also mentioned this notarized paper of some sort?) , and so, I was wondering if anyone out there that has a legal background could help me out, and sortta tell me If I can actually get something to keep him away from me, because He does have anger issues and he would actually harm me if he got angry enough. I just wanna make sure I can (legally) protect myself from him.

o.k. as a side note, there were other witnesses of him threatening me, AND (to those that say I just don't like the guy) its not the fact that I don't like him, its more or less that he presents himself as a bad guy. I mean he also threatened to smash her windshield, scratch up her car, and take my sister by force. He's also forced his way into our house like 3 years ago, and nearly attacked my mother.

By the way, I AM in California, and also i am under 18 (so would that mean i need at least one legal gaurdian present?, which would not be a problem, I've still got my dad.)

Yes you can get a restraining order, I was in a similar situation someone threatened me with violence although they hadn't done anything they also had a past record of assualt so I was awarded a restraining order instantly. Visit your local court house and they will give you application forms. Once you have done that you will get a hearing date where you talk to the judge without the offender present who will then make a descion whether or not you have a cause for one. Just remember this is a form of domestic violence and there are strict laws in place don't wait for something bad to happen take action now

If you were in California, what you describe is sufficient grounds for issuance of a civil harassment restraining order. However, laws vary by state and you should consult a local attorney regarding the proper procedures.
