but the evidence was never taken from the scene?

The photos from the scene must be authenticated as coming from the scene by the person who took them or by another person that can testify that the items shown in the picture are items the person saw independently from the picture.
The term for this is authentication.

Photographer is to be eximined first for the photo & relevant evidence.

It has to be thrown out . Its tainted evidence. fruit from the same tree.
