so a few of my friends are in jail b/c of somethin horrible..well basically it was a drug deal gone bad..but there was four of them and one victim..two of them are in more trouble than the other two..they are all gettin charged with assault burgulary and kidnapping first degree..they havent been to trial yet.but like one of the guys shot the victim..he was the only one that shot him and he shot him through the chest and it came out the back of his shoulder..the guy had to be stat flighted to a hospital it was that bad..but the guy who shot him is not gettin charged with attempted murder..he is only gettin charged with assualt just like everyone else..thats not fair b/c like one of the guys only held the mans feet down...im thinkin shooting someone in their chest is alot worst and should get in more trouble than someone who held someones feet down...why would he not be charged with attempted murder?..isnt that wrong that hes not?? oh btw...this all happened in kentucky.

well the victim is not goin to die..this happened almost a year ago..and they still havent been to trial..it will be on year in like two weeks..but actually one of them is my boyfriend..you really would have to know the whole story before you say **** about it..my boyfriend and another one is in less trouble b/c they didnt do anything..they was just there..the victim said that in his statement..but b/c of the fact they was there..they have to get in trouble. and im not friends with the guy who shot him...hes a piece of **** bastard.

well my boyfriend is not a bad person..hes never been in trouble..he was just at the wrong place at the wrong time..i didnt ask anything about weather i should stay friends with them or any advice of that sort so please dont say anything like that..two of them had it planned out then they picked up the other two w/out tellin them what they was doing...but the victim told the police who shot him..they even gave him a lie detector test..and he failed..he admitted to shooting him at one point to the police after they went to jail..now he says he didnt do it..but they have enough evidence to know he did..but when he did admit to it..he said he didnt mean to hit him he just meant to scare him..but he shot at him three times.so thats stupid.

oh..& no plea barganing has been goin on..this is also stupid..they told the one who shot him..they offered him 20 years and if he took the plea then they would all get plea bargains..if he didnt accept the plea they had to go to trial..well he didnt accept so now they are goin to trial..so now hes gonna be gone forever..b/c he got 9 years just for havin the gun PFO or somethin like that..

Sounds like some plea bargaining has been going on. The Attempted Murder is plead down to an Assault (you sure it's not Aggravated Assault) and every one pleads guilty to the lesser offenses.
Fair or not, that is the way a lot of serious offenses get handled.

Your right it is a more serious offence, but depending on the evidence it could go either way.
For example if he shot him not intending on killing him just scarring him it's not attempted murder. You don't know what the victim told the police so you don't know what evidence they have.
But a little piece of advice, get yourself some new friends, the ones you have are bad news and if you stick with them you will get involved in something similar one day and may be killed yourself.
No one is invincable!

To charge attempted murder, intent must be proven. WHERE the victim is hit is actually not an issue. Intent to fire the gun is an issue.

The bigger question here is why are these your friends? If the victim dies, then it will be bumped to murder and it will bode ill for all of them.

The prosecutor has the discretion to prosecute a lesser offense if he wants.
