My husband and I filed a joint return...however someone in a different state(just so happens to be the same state as my husbands ex wife) used my husbands name, birthdate and social security number and filed a return fradulantly. Because this thief got the return in ahead of us he was able to have the return depostited directly into his accouont. It has been several months since I filed and I still do not have an answer as to when I will get my return. In fact I am treated like a criminal whenever I call for a status. My local congressman also has an inquiry submitted with the tax payers advocate office(thats a joke ). I am just wondering if anyone can give me and info on how to expedite this process. I need this money ...I am owed this money and if it were the other way around you can bet I would be being billed interest. Any ideas please help.

If you can afford it, find a good CPA or Tax Attorney to work with you with the IRS to resolve this. They will more than likely have you and your husband sign a form 2848 - Power of Attorney so that they can deal directly with the IRS on your behalf.

Even if someone else fraudulently filed a return with your husband's name, birthdate and social security number, your joint return (filed after that one) would have been rejected, but your refund for the joint return wouldn't have gone into the other person's account. Since the return wouldn't have been accepted, though, your refund would not have been processed. At this point, it might be that, as far as the IRS is concerned, your return was never filed.

Totally agree. Income tax was only introduced as a temporary tax during the Napoleonic Wars but has never been revoked. WE SHOULD ALL REFUSE TO PAY AND ASK FOR A REFUND! NB - old know all seems to be getting income tax confused with National Insurance contributions.
