Try to get a fiance visa and then have the person return to their country voluntarily. All undocumented aliens are not illegal. Overstays can return without penalty for example. But if the person entered illegally, false documents not at a port of entry, or false claim to citizenship, they are illegal. A fiance visa is the quickest provided the person hasn't been previously deported or doesn't have background problems. At the very least, deportation can be stopped if you file the necessary papers before the deportation order is made. Try to get a reputable immigration attorney.. Immigration attorneys are the most likely to be disreputable because their mistakes end up in a foreign land.

If he's in his country and he's never been deported and has a clean record i would recommend for you to file the paper on you own, They're easy to fill out. you can file forms 129F (Petition for a Fiance) along with the Biographic Form, I forgot the number for that, but you can go to www.uscis.gov and download the forms and instructions. While the petition is being processed and you don't waste time since they'll ask for this later on, gather proof that both of you have known each other for the last 2 years, prior to the submission of the petition. (They usually ask for photos, airline tickets, letters, if you have calling cards. After you submit the petition you'll receive a receipt # and then more than likely they'll ask for the proof that I mentioned above. It takes around 5-6 months for the petition to be approved and after that around two more months for your fiance to come to the US depending on how fast you respond to letters. After he enters the US, you both have 90 days to get married through court, and after that then you apply for residency.
If your fiance is here I would recomend for him to go back to his country, and I his ever been deported then I would recommend hiring an immigration attorney.

BE CAREFUL! The process is much more difficult for illegal aliens, because there are thousands trying to do this legally. Whether they penalize illegals or not, I do not know. I do know they ask about current status and past deportations. Juarez alone has roughly 500 applicants per day trying to come legally.
You must be prepared to be separated from your soon to be husband.
I advise to see an immigration attorney BEFORE you get married to know what could happen.

Did you ever think that you are being used for just that reason, and by the way it is not undocumented it is ILLEGAL ALIEN, I agree with a previous poster - Traiter, you and him should both be deported.

That will be a risky situation unless as said above, he goes home and you marry him there.
DO try to comprehend the word Undocumented.
It can very well render any wedding you have in USA, void-(not valid, not real or no good). Why waste your time and money like that?

I know you don't want to hear this but, your fiance is not an "undocumented person." They are an ILLEGAL ALIEN CRIMINAL! THEY ARE BREAKING OUR LAWS!!!!!!
To gain residency they must return to their country and start the paperwork there! Don't plan of waiting for amnesty because it's not coming!
