Yes he can get the benefits of section 24 of the Prevention of Corruption Act1988 which clearly states Notwithstanding anything contained in any law for the time being in force, a statement made by person in any proceeding against a public servant for an offence under Sections 7 to 11 or under Sections 13 or Section 15, that he offender agreed to offer any gratification (other than legal remuneration) or any valuable thing to the public servant, shall not subject such person to a prosecution under Section 12. Here it says person which will include any person who has given or offered the bribe whether he is complainant of this offence or not, had this fact clarified that he should be only that person who actually makes complaint in this section then we could have said he cannot get such benefits but as there is no such clarification here in the section hence he, if he becomes a witness & makes a statement in any proceedings against the Public Servant for the offence of taking bribery he gets the benefits of not getting punished for the offence of giving bribery to such a Public Servant. Isn't it nice to first give bribery to get things done & then get the Public Servant who was given the bribe get him punished by making statement against him in the court proceedings & going scout free of getting punished oneself for giving such a bribe.
