A relative of mine was recently in a car accident. He ran into a neighbour's parked car when he swerved to miss hitting a ball that rolled onto the road (thinking a child would follow). He is on his full license (black and has 12 demerit points). When the policeman came he said that my relative would go to court and lose his license, he then measured skid marks on the road (from other people's cars) and interviewed neighbours who were not present at the accident and who did not witness it? Does anyone know whether this could go to court and what police/witness protocol is? eg. can police use witnesses who did not witness the accident?

The measurement of the skid mark was to determine the approximate speed of the vehicle at the time of the accident. The only reason to interview others who did not see the accident was to see if they had any children playing near the road at that time. If he couldn't find any, he will probably report that, but not call any of the people interviewed as witnesses.

The police officer cannot determine if your relative would lose his license. The court will make that decision.

Car accidents go to court when none of the other person accepts his mistake/ when the accident is severe enough to cause injuries.

If he was cited, he'll have to go to court. Merely because the cop spoke to someone who didn't witness the accident doesn't mean that he'll call them as witnesses.
