this guy in ny were we are got out for stealing a car in 2 days and my husban still in there with a 3rd degree the other guy had 2nd degree Does anyone understand. and also they wont give him a lawyer and miltary wont help us

If he got arrested, he is entitled to a lawyer, it is his right. Also, the degree of the crime sometimes depends on prior arrests/convictions, intent, who was driving, etc.
You should be able to get a public defender. Encourage your husband to find one, or better yet, you contact one. If the other guy got out already, he had to have posted bail. Was your husband arraigned??
