BAS is for you, the military member and should not be included or considered wages. The same is said for housing allowance if you are receiving the single rate. If you are claiming your child, and receiving extra for the dependent child then that counts as income. You have to have custody for over 50% of the year to claim housing for a child! Contact your legal office for better advise...it is free, and they know a lot more than me (at least I hope so for your sake)!!!

Technically they can look at your BAH & BAS to figure your child support order. However you may get someone who is willing NOT to include this amount. They are allowed to take this money into consideration because the money is paid to you so it's considered part of your pay....

Well he will lose his BAH as he will have to move back into the Barracks... The amount of "Child Support" is what ever the Judge says it is... They do not Tread Lightly... Plus he has to supply medical "Tricare" for the Child... until age 23 if still in school... Be aware that he can ask for a DNA test...

strictly dependant on your state's laws. some do, some don't. some take into consideration if you have other children, some don't.
keep inmind that if BAH is counted, you have the rightt o demand a recalculating every time you PCS, since BAH rates will change. and deifinitely if you come back from an OCONUS assignment and lose COLA.

In California ALL pay and entitlements are included when they figure out what you'll pay for Child Support.

Nope only base pay. If you include anything else you will be a very poor man for a very long time. Be very careful and make sure you have a good attorney. Don't go it alone or you will have troubles for a long time. Find a military experience attorney to go to court with you. YOu will be thankful you did.

the navy has a set amount they pay for child support per child.
it is based on your pay grade.
it should get added to your les as BAQ dif.
