My boyfriend and the father of my two sons is being held by immigration on a deportation warrant. He will be sent back to Haiti in about 3 weeks. He has been in the USA for 27 years he has a legitimate full time job where he has worked for the past 18 years and he pays taxes. My children will suffer for this unfortunate problem they will have to grow up without a father and my oldest son is 14 months and we have another son on the way who may never have the chance for his father to ever see him in his lifetime. My boyfriend also has a life or death medical condition, he has a blood clot in his leg that could travel and create serious harm on him or death. He was scheduled to have surgery two weeks after he was picked up by INS, he has his own health insurance, he does not depend on the government in any kind of way. But noone seems to care at all. It will be very hard to raise two sons on my own. Is there anyone that can help us?

I really don't think so. It could depend on what state you live in based on the marriage but I am pretty sure he will still be deported. I know someone that was married and had kids with a guy and they still deported him. TWICE. They said if she wants to live with him she has to move to Mexico.

Something about this sounds fishy to me. If he is "paying taxes" then he has to have a tax id number (ie. social security number) How does he have one if he isn't here legally?

He has to go back regardless of your marrying him. You might be better off letting him go back and petitioning him through a Fiance' Visa.

The Immigration laws have changed many times since 9/11, and are being redesigned as we type. INS is under Homeland Security, and the laws are tight.

If possible, his best action would be to return on his own before he is deported. If you could tell the authorities that you will buy the airfare, and he will voluntarily return home without being deported, it is a plus in his favor. If he is deported, it might be an automatic 10 years before he can re-apply. If he goes back on his own (before deportation proceedings), then he has a chance to get here earlier than 10 years.

Go to http://www.catholiccharitiesusa.org/ and enter your state in the left hand side of the home page. They'll have a list of Immigration Legal Services for you.

Unfortunately, Medical Conditions, Love, Children, and Paying Taxes aren't considerations. I know it hurts. I hope this helps.

It is funny how some guys here don't have a clue. Since his dad tried to marry someone for that that means they came in legally that means you can marry him and adjust status. if you are a citizen that will take about 1 month (even though they say it takes 6 months. My friends got married he got everything in 3 weeks). If you are a green card holder that would not give you enough time to stop deportation for your boyfriend. Sorry! Hope I could help!

How long have you known he is illegal? 27 years is a long time. Illegals can and do apply for residency all the time and have a very good chance of staying when they do. He did not have a legitimate job however. Just because he paid taxes means nothing unless you wish to imply that since he is illegal he should be exempt from taxes. In other words illegals should get the same police, fire,and educational benifits as everyone else but not have to pay for it.
Get a lawer, but he probably will go back. He can then apply for legal immigrtion.

If he's been held by immigration you'll need to talk to a lawyer/immigration consultant about his situation. Also see if you can get your boyfriend's doctor to write a letter stating that your boyfriend is not fit for travel (you may need a letter from your boyfriend or a court order to get the letter before the doctor will release it).

You might find it a bit hard to get married if he's being held by immigration. Not to mention filing the paperwork would be more difficult with immigration because the warrant is issued and they are aware of it.

I feel sorry for your children, however.

Under current law, I think there is nothing that can be done if you mean an actual order. However, you had better speak to an immigration attorney, not us.

And why on earth wouldn't your baby ever see him? Americans can visit Haiti. Or go there to live, for that matter.

If he has been here 27 years, he had his chance in 1986 to become legal. If he wanted to be legally here, he would be.

Therefore, he is being deported and there isn't much you can do. Call immigration or contact a lawyers, but other than that, I don't think that there is much you can do.

Also, if he is illegally here, there is no way for him to be working legally.

Great story.

Why didn't he apply for the amnesty that was given back in 1986? According to you he'd been here illegally for 6 years at the time Reagan handed out amnesty. Almost 4,000,000 illegal aliens became citizens back then. The deadline for the 1986 amnesty was extended over and over and over. They were still taking applications into the early 1990's.

Get a good lawyer, probably for medical reasons he can stay, but deportation is a big name here, and 1% of people can beat deportation, his case is serious, get all the medical evidence, and get a good lawyer to see what they can do for him.

I doubt that anyone is without sympathy for your situation, but in those twenty-seven years why didn't your boyfriend take advantage of the two amnesty programs that were offered to illegals?
