My mother was threatened at work twice and wants a protective order. Both times she called the police and they arrested the guy. The company didn't do/say anything to the guy and the manager said she can not get a restraining order without his permission because they work together. Is this true and is it wrong that the company did not do anything to this employee?

So today my mother was officially fired from this job. They said it was for poor quality work or something like that. They have never in the 20 years she worked there even written her up for anything. And to top it off they gave her job to the guy that has been threatening her.

the employer is opening himself up for a civil lawsuit. he is required by law to furnish a safe working enviroment.someone needs to explain this to him. he has absolutely no say so in filing a rfestraining order

No that is not true. She can get a restraining order against someone even if the work place doesnt agree. She needs to ask the police for it and go before a judge.

IF this is happening in the U.S. tell mom to write a CERTIFIED (RRR) letter to the director of Human Resources at work AND copy the corporate compliance officer or the company president.

In the letter she will detail what has transpired, the protective order that has been obtained and the arrest and the supervisor's statement regarding what she is allowed to do and not do.

Also, in this letter tell her to type the exact wording found here:

Therefor, I am requeting that you take appropriate measures to insure a safe and hostile-free workplace and to resolve this issue to the satisfaction of state and federal laws and the safety of all employees.

Also, send a copy to your state Department of Labor, director of compliance.

Have your mother point out the fact that if he does anything to her (or anyone else for that matter) while on the job they would be legally responsible. Recently there was an incident like that where my husband worked and the guy was fired on the spot.

If he threatens imminent physical harm, she can get a temporary restraining order WITHOUT his permission or notice, etc. Not only that, but the cops could arrest him for assault.

Call the dept. of labor. They can tell her her rights. This is thier job.
