FORGET YOUR VIEWS ON THE RIGHTS AND WRONGS OF SMOKING. Yes we all know its bad for you but this question is not about that
I feel that in a little over 3 weeks I will go from a normal hard working law abiding tax payer, to a criminal. Not only is the Smoking ban coming in but now the councils say that they are going to ban it in the street also. They are going to impose £100 on the spot fines if you drop a butt on the floor, but they are not going to provide any litter bins (London has ZERO litter bins) for you to use. This is PHUCKING ROBBERY in my mind. TAX TAX TAX TAX.
My question is this. How will they attempt to enforce this (in the street)? What are there powers? And what are the loopholes?
Can I just tell the council person to "get stuffed" if he asks for my name and address, then walk away?
How about this? If he has the legal power to detain me to ask my name and address. If I answer "accurately" but speaking so fast that he would never get it. Have I complied with my requirements to the letter of the law? Do I legally have to repeat myself as many times as he requests until he gets it?

The Mofo - Hmmm I am not sure your info is acurate. It will be the councils who will enforce it, not the Police. You maybe called in to back them up if things get heavy.

If I do find a Litter bin, can I drop it in there? It will cause a fire. But if the council say its litter then its litter. So I guess I can and I will. That will be my protest and let them take me to court for starting fires. They cant have it both ways.

James - Mate you are wrong. The reason they took the bins away in the 80's and 90's was security reasons (IRA). That situation no longer exists and today’s threat is completely different. The reason they don’t put them back is the cost of emptying them. Are we the only major City in the Western world under the treat of terrorists? We are the only one without litter bins imposing £100 fines for people littering. CRAZY.

I don't smoke, and never have, but this is truly ridiculous. It doesn't surprise me that it has gotten to this point. There are many cities in the U.S. that have banned smoking in all public places, including bars.

You are right. But alcohol causes more damage to our society, and yet pubs and clubs seem to be open for longer and longer. Shops sell alcohol for 24hrs in some cases and it is the same bunch of cretins in the council who give them licenses to do so.
Yet they ban smoking, and threaten to fine people. Bin Laden has a lot to answer for with the removal of bins, this particular Bin.
Although I don't smoke, the anti smoking laws are the biggest waste of time and money. If the litter laws are enforced then maybe the cretins will do something about the selfish shoppers who dump shopping trolleys in the street.

Where is it written that we can no longer smoke in the street soon. I would like to know?
I am sick to death of this dictatorship that we live in.
The Police and the Courts have enough to do, and more important things than chasing after people who smoke in the street.
I have a solution to your problem of dropping cigarette butts though. I know that you can buy personal pocket ashtrays that have a snap shut lid. I had one once. So if you get one of those you will not drop litter.
P.S. What are the government going to do about all the ' neurotic ' people when they are giving up smoking lol!

i think i wont be going no were
have no clue what is going to happen but all i do no is we will be taxed for farting next
fed up already with the smoking Ban and it has not started yet
and all you non smokers out there yes i no it is bad bad bad but also is a lot of other things and i am not giving up my ciggies for no one

I don't smoke ,but as I see it this is just another test to see how much freedom the people will lose before they complain or revolt, we are on the verge of losing all of our freedom and many of our weak minded people will sit by and say what can we do , what did our forefathers do? they took up arms and said no more will our people have the guts to do the same ? our freedom has been eroded for so long we have very few liberties or freedom left ,are we going to succumb to these hi and might scoundrels or fight back? simple fight or be enslaved. what will you do?

it is a total joke, i have already Had the smoking ban for nearly a year, i hardly go out now, better and easier staying in, in the warm and comforted of your own home and space,they should stop drinking, as there are far more hassle from that,what ever will be next.

well to be honest if you drop a cig butt on the ground they have to prove it's urs and the only way to tell is either CCTV or DNA....if theres only one of them that try and take ur name just say its not urs and be polite about it..because if ur rude then they will call the police and thats when ur get arrested for refuseing to give information to a person that has powers to give on the spot fines (the ppl give the on the spot fines go to court to get these powers to do this.

a council person will not be the one enforcing it.
Us hard working coppers will be forced to do it. another unpleasent task we have being puppets of beurocracy (spelling?).
Trust me, we dont want to, but we dont chose which laws to uphold.
And police have the power to arrest for any offence lagislated, so can chose to arrest and charge for that offence, or if you give correct details coherrently report you for court
trust me, i didnt join the job for this, but in order to do the other good stuff we gotta do this stuff too
