it isn't about whether you have anything to hide, this is about the children. You may need to pay for an attorney just to make sure you get want you want. It may appear that the court is on your side because of the history of the fathers but you would be surprized. What if the dads agree to get counciling, or agree to do whtever the court says they need to to get custody..... the point I am trying to make is sometimes the court system can be screwed up. Altimatly it is in the courts interest to keep children with family. I would get an attorney.

A few years ago, my childrens dad beat me up in front of my daughter who was 3 at the time and at my job. I was embarased, humiliated, and angry. I received 6 stiches in my rt eye. Keep in mind this was not the firt time this has happend. he was in violation of a civil protection order. What happend to dad.... He was charged with 2 felonies, pleaded guilty to only one and got 6 months work release and 4 yrs probation. He didnt even HAVE A JOB!!! He is in violation right now of his probation because he isn't working. Tech. he should be sitting in jail but he isn't. I realize the situaions are different but the point is the same.... you may not always have the rights you deserve.

As a Paralegal who graduated from a college in Cleveland but residing in Fla. the only emergency child custody is when a police officer and/or child services agent takes temp custody of a child usually from an hostile environment. The child is taken from both parents til the proper authorities make a decision. Here in Fla. Dept of Child Services can remove a child for up to 6 months from a family deemed hostile toward the children. If you fear for your children you can file for a temp restraining order barring him from seeing the kids til a court hears the case for permanent custody. Now for this you must show just cause and proof of your claim. The costs are whatever an atty charges for his help.
