Creditors don't care about divorce papers.
If it's in your name, or in both of your names, and she files for bankruptcy, they will probably go after you.
They cannot legally go after you for debt that is only in her name.

Studly is right, it does depend on what you state laws are. If you live in a community property state and the debt was inccured during the marriage then yes, you are still repsonsible for the debt if she files Bankruptcy or even if she does not pay it.

The only thing the divorce decree does is give youlegal right to go after her if she does not pay it and you have to. If you end up paying anything inthe papers and she does not file, then you have recourse on her for the money owed.

This is another of those "depends on the state you live in" questions.....

The court order does transfer responsibility to the spouse. But I'm not sure about the effect of a bankruptcy. Your BK lawyer will be able to answer this one for you. If I had to guess, you are covered...but with the variety of state laws you need to check.

If she doesnt pay off the debt that is in your name your credit can be ruined and you will have to go back to court to get them to again order her to pay it. Keep track of the bill payments which have your name on them.
