I hve been paying child support for 2 kids of mine that were emancipated 9 years ago, but since I have a 3rd child with her I just thought it was for her. So how do I motion this into court and do you have any examples of motions that I could use. All the attorneys I contacted wanted money and I do not have it .

You go to the county child support agency where your order is and speak to the case worker. By law you're entitled to a review every three years--sounds like yours is long overdue.

my husband has been going through the baby momma drama with his ex....if you call child support, as the father you won't get the actual case worker for the case you get the go between and they just like to confuse you. you can go to the magistrate a petition for a review or a reduction on the basis of the 2 kids being emancipated, you'll have to bring proof of that and what you have been paying...the case worker will stall on the mothers behalf if you depend on her. she is not there for you only her...remember that.you can motion to the court for a legal aid attorney, but again most of them are working for the system.

Contact your local Child Support Enforcement Agency. There is a case worker assigned to your case (from the beginning) and you have the right to have your case reviewed if situations change and it looks like yours has. Good luck to you.

look online or through government agencies for an organization called "legal aid". essentially you just wait in line to ask an attorney a question and it will be up to them to take your case pro-bono (free) or give you advice and send you on your way.
