my husband will have custody of his son in the next month.....they have reach an agreement to stop child support in their california case....however, his ex is saying she doesnt know where to go to stop the case.....???????? wouldnt it be where she opened it in the first place

I wouldn't trust her to stop it. Your husband should speak with whoever ordered the payments and make them aware of the change in custody. I'm sure she won't be in a hurry to stop the money from coming.

Yes it would. Your husband needs to file a motion to terminate support, forms available through local clerk of court's office, to insure that the Court stops the order and the paperwork is appropriately prepared. Don't depend on the mother of the child to do this. Many simply don't do it or "forget" which leaves the order in place and makes problems to clear up later.

They will both need to contact the child support agency enforcing their case. The agency should be able to provide a stipulation to end child support--both should sign and they will end child support when your husband takes custody.
