If i get a felony reduced to misdemeanor for a NON-drug or violent related crime do they drug test during the 1 year of probation? I don't see why they would since it has nothing to do with the crime but I wanted to make sure.

I would agree that if there was no drug involvement in the crime, they shouldn't have a reason to do drug tests. On the other hand, they call it probation for a reason, i.e. any thing you do wrong during the probationary period (computer crime related or not) can get the probation revoked. Accordingly, they could make drug testing a requirement of the probation.

Most states it is mandatory for your first time in the probation office they drug test. After that if it isn't a drug test they won't, but they have the right to if they think you are on drugs. I wouldn't take the change, if you are a first time offender and they reduced it to a misdemeanor and you violate your probation with a positive test they could sentence you for a felony and you could do jail time.

Here is a start, DONT DO DRUGS! Then the problem is solved. However, to answer you question, YES! They can drug or alcohol test anytime they want while on probation. Your butt belongs to them.

Impossible to tell, depends on your probation. Please remember that you lose a lot of freedom when on probation. In most places a probation officer can enter your dwelling without a warrant to check on you. They can violate you on the spot, causing you to have to reappear before the original sentencing judge.

just stay clean for a year - you never know when these guys will want to surprise you...
