i have done every check under the sun but every time i just take off it disables itself what to do and i am not giving up its taken me 4 years to build and 1 year to pass inspections

the wind dose not seem to be a proplem interfering with the rudder i had crash once because of this problem never again caused a lot of trouble at gatwick !

Difficult to answer without the drawings of the plane! Email me a copy.
The word "fail" is very vague: how is the rudder "driven"? Cable? Servos?
Without a wind tunnel, you could try stationary (with chucks under the wheels), push the engine high rev and see if the rudder "works".
To what you say, sounds like your rudder fails when you reach a certain airspeed (take-off speed). This could be the result of the stream from your propeller (secondary effect of the throttle: stream rolls around the fuselage and hits the rudder and pushes it one side)
One thing, though: if you have a C of A from the inspections, I suggest you go back there and ask them. If there is a failure of the rudder, you can't get a C of A!

is it possible that the extra windage when you are in flight is causing the mechanism to stick, do you have access to a wind tunnel to test it while the aircraft is stationary , but with wind blowing at the rudder

You got a tail dragger? Maybe not enough rudder design for takeoff.
