I recently found out that I have hpv. I am worried that the guy at the front desk at my clinic might have access to that information. Well the problem with this is that I made the horrible mistake of sleeping with him. Although maybe he has a right to know, I can't discuss that with him because he doesn't comprehend certain things and he has a lot of problems. In other words he is a moron/stalker/psychotic type of a guy and he might just assume i gave him hpv without knowing all the facts. Since I have been going to this clinic for years I don't want him gossiping about my personal buisness with the other employees. So does he know?

He only has access to what he need to do his job which would be your billing and ins info. If he ever looked at your personal health info and spread it or was just looking and someone in the office found out a reported him he would face federal charges plus getting fired from his job. HIPPA is in effect to protect peoples personal info the only people that would know would be nurses and doctors in the office. Basically to everyone else front desk, ins office, medical records, you are just a name and DOB .If you feel ever threatenend by him or think he has been looking at your records ask to talk to the office manager at the office and she can assist you in confidentially filing a report and charges.

I agree with the first three answers given and as for your final question - So does he know? We cannot answer that one.

The "guy at the front desk" is a medical assistant. Not a nurse and not a doctor. He has no legitimate reason to browse through your lab results or progress notes. His job is to make appointments and take phone calls. He has the authority to use the minimum amount of information necessary to perform his job duites, and no more than that. If it turns out that he has done so, you have ethical and legal grounds to act on this. However, you also have the moral and ethical responsibility to inform him of possible exposure to HPV. He has the right to know. Unfortunately, you can't control what he does with the information but you can take action if he does something foolish. It will have to be after the fact.

If you're uncomfortable with having to face him or the other staff (all medical assistants) after this, you can always change doctors or clinics. It's sad and inconvenient that you might have to reestablish with someone else but it may be inevitable.

I am sorry to say that he probably does. Depending on how large the office is, he may very well come in contact with your file. He is required by law to sign a confidentiality statement regarding any personal information but that is not going to be much help if he only wants the information for himself. If the clinic is very large, he may not do filing or placing lab results in charts, but if the office is small you can be sure he does. Is it possible he gave the HPV to you? He may not gossip if there is that possibility. I am so sorry for your situation.

I don't know what responsibilities front desk workers have at your clinic. Do they just make appointments, or file your medical files. If they just make appointments, he probable doesn't know. If he files then he has access, he' should have been instructed not to read the files, but you implied he lacks ethics. He may know, BUT if you've slept with him it IS your responsibility to tell him. Most clinics will make an effort to have your contacts notified. What have they explained to you?

It is very possible that he has access to your records, if he really is that obsessive he may not care and look anyways. Yes he has the right to know and remember he may have been the one that you got them from. However if he does look in your records with with no reason and it is not part of his job that is grounds for termination and possibly a law suit. All employees in a health care setting have to follow HIPPA regulations.

Unfortunately if he works for your MD he has access to the files - if he or any other worker has read or shared the information it would be in direct violation of the HIPPA regulations. If he or any other person read/shared your information you could sue for breach of privacy even though the information may effect him he has no right to investigate your private medical file.
