I have been a tax accountant for 27 years. You did say "tax lien," so I must assume you have been contacted by one of the private tax collectors the IRS now uses to collect taxes. If the collection agent threatened that he or she would file a tax lien, he or she has violated the law. Inform him or her at once that you do not want to be contacted by their company again (you have the right to do this) and also report the company to Taxpayer Advocate with the IRS in Washington, D.C. The National Taxpayer Advocate has received so many complaints about these creeps, and the creeps are proving to be so ineffectual and inefficient, that the NTA is recommending to Congress that the IRS be told to stop using private collectors.

only the irs can file a tax lean on you.

Only if he's collecting for the tax collector. (And only if it's NOT for the IRS.)

I believe they would have to go to court, win a judgment and then if you don't pay the judgment, put a lien on your property, wages, etc.
