We came with my husband as dependent on l2 visa, my husband have already filed his return for last year 2005 to 2006, we both me and my daughter are not having ssn, so for ITIN number we both me and my daughter will have to file return separately or my husband can give our reference into their file return, and what document will be required for that, can we apply right now for ITIN number or it will be applied that time only, please guide us.

I have been a tax accountant for 27 years. You can apply right now for ITIN's for you and your daughter regardless of immigration status. You and your daughter can be included on your husband's tax returns: there is no legal reason preventing this and no requirement that you file a separate tax return. Just get the ITIN's and have your husband amend his tax returns for the years in question.

Go to IRS.GOV and forms. Get a W-7 for yourself and your daughter to fill out. You can also call the IRS toll free forms order line in your phone directory. With an ITIN your husband can fill out amended returns and get a refund for the tax years in question.
