My exhusband had not been in my sons life since my son was 3 years old..My son is 10 now and my current husband has been raising him..My ex husband died 8 months ago and now my son would like to have the same last name as me and my husband..do we need a lawyer to do the adoption..there is NO ONE to contest this and my son wants it very very much

Still need a lawyer. You will also need a copy of your ex's death certificate. Happily, it will cost less since it is uncontested.

Yeah, he could of adopted him the day you met your current husband. All you need to do is go your county court house, and ask them, they will need papers, probably a ton, concerning your husband, and a signature from your husband stating he want to be the primary father, they will give ya a new birth certificate and all that good stuff. The only reason you may need a lawyer is if your in-laws get involved.

A GOOD IDEA IS TO TALK TO A LAWYER OR GO TO A JUDGE THAT DOES ADOPTES. YOU MAY NOT.BUT YOU GOT TO THINK ABOUT GRANDPARNETS TOO. I DON'T SEE WHY YOU CAN NOT GET YOUR HUSBAND TO ADOPT THE LITTLE BOY. BUT YOU NEED TO GET ALL THE PAPERS THAT THE FATHER AS DIED. I MY MIND YOU WILL HAVE TO GET A LAWYER TO GET THE PAPERS READY FOR THE JUDGE TO SIGN TO LET YOU HUSBAND THE RIGHT THE SAY HE IS HIS. THE JUDGE HAS TO TALK TO THE CHILD TO SEE IF THIS WANT HE WANTS. AND HERE A SOMETHING YOU MAY WANT TO THINK ABOUT NOT REMOVING THE CHILDS LAST NAME JUST ADD THE NEW NAME TO IT.SO HE WILL HAVE A PIECE OF HIS DADDY LEFT WITH HIM.

My son's dad died while I was pregnant with him, and my current bf and I have been talking about him adopting my son when we get married. We will do it through court though. Your son is probably eligible for SSI benefits, as well, and these do not stop when the child is adopted.

he can adopt with a lawyer. but it would be better just incase legalities threaten what's going on.
