you can keep the money, big draw back is if you get in a wreck again in the same spot they may decline claim, regardless if there is additional damage.

Generally, no. In fact, many insurance companies will make the check out to the contractor who is doing the repair jointly with you. Some will even send a representative to inspect the repair to ensure that it was made.
After writing this, I read the other answers. The answer depends on the type of insurance. If homeowners, my answer applies.

If the property is without a lien holder/Loss payee or additional interest the YES. Otherwise the check is made out to (2) parties.
If it is your property paid in full and the check is in your name it is OK but don't file a claim again on another like claim on the same property. They will denie it if it wasn't repaired.
