and now i getting done for it cause he came off worse and his mate said i started it.

what shall i do ? there was no other witnesses?

GET A LAWYER!!!!!! I'm with you buddy, I believe that people who start Sh-t deserve whatever they get. I'm sick of people interferring with others; being threatening; and even assaultive and getting away with it. A good *** kicking is the best remedy because the courts and the law won't do the right thing. An *** kicking is something they will remember and maybe think twice the next time. Also what the people who answered you do not understand is that when you are in a fight and may really get hurt, you cannot stop and think about pulling back or only going so far, etc. You do what you have to do until the other guy stops. I believe that this is true on an international level as well. For example, everyone is always preaching to Israel about restraint. Screw restraint, those other countries attacked unprevoked and deserve what they get. Don't give back land. Kick their M-F-ckin asses!!!!
Unfortunately, human nature and the law, usually side with the "injured" party or the one that seems most like a victim. In other words, the loser. Self defense is very tricky and I know of people who were changed with crimes just for defending themselves. Two cases come to mind, in one a young man was accosted in a park, by two other men. One of the other men pulled a knife. The guy took out his own knife, charged the two guys and stabbed the one with the knife in the chest. I think he was a hero. The judge thought he used "excessive force" and charged him. The judge actually said he should have run away. Yeah so he could be stabbed in the back right? The other case was an old woman who lived alone in a house in a bad neighborhood. The punks in the hood kept breaking into her house. After this happened a few times and she felt terrorized and unsafe she actually got a rifle. The next time they broke in she shot one of them (GOOD!!!!). She was arrested for assault with a deadly weapon and for not announcing "I have a gun". The judge said she used "excessive" force. BULLSH-T!!!!!!!!!!!!!!!!!!!!! Get a lawyer!!! Don't let them railroad you. You did not injure anyone on purpose and he wouldn't have been injured at all if he didn't start a fight. When you start fights that's what you risk, the risk of being injured. You did not INTEND to injure him but felt you did what was needed to stop him from harming you. Was he larger than you? Was he particularly aggressive? Did he swing first? Did he use an object at any point? Was he getting the better of you at any point? Did you try in any way to get out of it or away from him or to chill the situation? Those would all be points in your favor. Was he drinking? Are you sure there were no other witnesses? Think about exactly how it started, what you did and didn't do to stop it and then why you felt you had to do what you did.

Sounds like you need a lawyer. As an expert in kung fu, the charges and legal penalties for you are likely to be stiffer, especially since he does have a witness willing to testify under oath that you started the fight--whether you did or not. I always thought that a big part of martial arts was self-discipline. You might need to learn to walk away from situations like this...and not beat somebody up just because you can.

If you really were a kung-fu expert you would know the answer. Besides, no legitimate martial arts practitioner would ever refer to himself as an 'expert', but rather would refer to a 'belt' colour. If you are going to make up stupid questions for Yahoo Answers I suggest you do a little research first.

Be honest about what you did. That's the best advice I can give you.

At the end of the day, they can only secure a conviction against you if there's enough evidence to support the prosecution.

Bear in mind though that there's a VERY thin line between 'self defence' and assault.

If you are an expert and you use this to cause injury then you can be done.

If however you were using this in self defence then that is different either way get legal representation.

Tough one but if you are trained in a martial art you should have the discipline to only use the appropriate force. Ok we don't know the full story, but if there's no other witnesses i don't know what you can do. If there was two of them i would say you could be forgiven for it as you were out numbered.

If you tried to walk away,if he menaced you in such a way as to make you fearful for your own safety.and if you merely neutralized him[didn't kick his azz past his surrender]you should be OK. Overkill,so to speak, is legally frowned upon.You did say you beat him up. That could be bad for you. His buddy stood there while you thrashed the guy?

Claim self defence, his mate isn't a reliable witness.

As its kung fu then you can argue that the whole practice and training is for self defence, obviously for you to even hurt him he has to throw the first punch.

If it goes to court ask you trainer to stand as an expert witness.

the fact you beat him up is evidence in itselfm you had greater skil than him and did more than can be construed as self defence.

in law just because somebody else started it, doesnt mean you have to finish it.

plus, he has a witness you dont

chances are theres little you can do

Sorry to say you will be at fault
if they have a record already for GBH etc you may stand a Chance but to be truthful to you i don't think you have much of a Chance get a real good lawyer Hun that is all i can advise
