if an autopsy is not performed, will the parents have any recourse?

Autopsy is performed by law if death is of a suspicious nature..if cause is unknown autopsy can be requested by family.

An autopsy supervised by a pediatric pathologist will give the best documented cause or causes of death. The findings could be adverse for the physician or they might exonerate him/her. There are times when an autopsy is inconclusive.

As to what recourse the parents have if they refuse an autopsy, that is a question they should put to a malpractice attorney. I think that any responsible attorney would recommend one.

In order to prove malpractice, there must be evidence. Evidence is secured through examination of the deceased, so unless the parents are claiming that the doctor dropped the baby in full view of ten people, it will be necessary to have an autopsy.
