speak to a marriage celebrant.... They can find all of that out for you. Where are you in Aus? I know a great one in the Northcoast of NSW- She's going to be my celebrant.
She's helping me to organise for my Fiancee to take on my name (yes a man taking the womans name- and no he's not under the thumb)

You don't but she does. Not to get married but to have permanent residency here and its a lot harder to do than it used to be. Now it takes a few years but she can get a work visa in the meantime.
